1. ACCEPTANCE OF TERMS
Welcome to DIYHome.app (“DIYHome,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the website located at https://diyhome.app (the “Platform”), including any related services, features, content, or applications.
By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
2. ELIGIBILITY
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Platform. By using DIYHome, you represent and warrant that:

7. USER CONTENT AND LICENSE

By submitting User Content, you grant DIYHome a worldwide, perpetual, irrevocable, royalty-free license to:
– Use, reproduce, modify, publish, distribute, and display such content;
– Incorporate it into our services and marketing materials.
You represent and warrant that:
– You own or have rights to the User Content;
– Your content does not infringe any third-party rights.
We reserve the right (but not obligation) to remove User Content at our discretion.

The Platform may contain links to third-party websites or services. We do not control or endorse them and are not responsible for their content, policies, or practices.
Your interactions with third parties are solely between you and them.
9. DISCLAIMERS
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:
– Merchantability;

– Non-infringement;
– Accuracy or reliability of content.
DIYHome does not guarantee that:

– Defects will be corrected.
DIY advice and content are for informational purposes only and do not constitute professional, structural, electrical, or safety advice.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, DIYHome shall not be liable for:
– Indirect, incidental, consequential, or punitive damages;
– Loss of profits, data, or goodwill;
– Personal injury or property damage arising from use of the Platform.
Our total liability for any claim shall not exceed the greater of:
– The amount you paid (if any) to use the Platform in the past 12 months; or
– CAD $100.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless DIYHome and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising out of:
– Your use of the Platform;
– Your violation of these Terms;
– Your User Content;
– Your violation of any third-party rights.
12. TERMINATION
We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including violation of these Terms.
Upon termination:
– Your right to use the Platform ceases immediately;
– Certain provisions (e.g., IP, liability, indemnity) will survive.
13. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to conflict of law principles.
14. DISPUTE RESOLUTION
Any dispute arising out of or relating to these Terms shall be resolved as follows:
1. Informal Resolution: Parties agree to attempt good-faith negotiations for at least 30 days.
2. Binding Arbitration: If unresolved, disputes shall be submitted to binding arbitration in British Columbia, except where prohibited by law.
3. Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.
Nothing prevents either party from seeking injunctive relief in a court of competent jurisdiction.
15. MODIFICATIONS TO TERMS
We may update these Terms at any time. Changes will be effective upon posting on the Platform.
Your continued use of the Platform after updates constitutes acceptance of the revised Terms.
We encourage you to review these Terms periodically.
16. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and DIYHome regarding use of the Platform and supersede any prior agreements.
